BASIC AGREEMENT (Basic Multilateral Agreement on international transport for development of the Europe-the Caucasus-Asia Corridor)
With the occasion of the International Conference for reconstruction of the silk road witch took place in Baku (Azerbaijan Republic), at 8 September1998, had been signed the Basic Agreement and its technical annexes witch regulate international road, railway, maritime transport and documentation procedures.
The signers of the Basic Agreement are: Armenia Republic, Azerbaijan Republic, Bulgaria Republic, Georgia, Kazakhstan Republic, Kyrghystan Republic, Moldova Republic, Romania, Tajikistan Republic, Turkey Republic, Ukraine, Uzbekistan Republic.
Romania ratified the Basic Agreement with Ordinance No. 20/2000 (Romanian version), published in Official Monitor of Romania, Part I, No. 34 from 28 January 2000, approved by the Law No. 95/2000 (Romanian version), published in Official Monitor of Romania, Part I, No. 223 from 22 May 2000. The Basic Agreement had entered into force for Romania at the date of 2nd July 2000.
Romania had signed this Basic Agreement with reservation, which stipulate that the appendix 2 to the Technical Annex regarding International Railway Transport is not to be applied in case of Romania.
The appendix 2 is referring to the preferential terms and tariffs, which will be applied for the Parties to the Basic Agreement:
- Up to 50 % discount on the full current tariffs for transport of goods by railway, except on preferential tariffs existing in relevant agreements and contracts
- For transport of empty wagons by train ferry, up to 50 % reduction on the full current tariffs.
The provisions of the Basic Agreement regulate the international transport of goods and passengers between the Parties and transit transport on the territories of Parties.
Basic Agreement purpose is in principal the following:
- o contribute to the development of the economic relations, of the commerce and transport links in Europe, in region of Black Sea, in Caucus, in region of Caspic Sea and in Asia
- to assure the access to the international market of the road, railway transport and of the commercial navigation
- to assure a secure circulation, integrity of goods and environment protection
- to harmonize the transport politics and legal frame in the field of transport
- to create equal conditions of competition for fulfillment of transport
